I am currently working for Company A on h1b, expiring on May 31st 2010. The GC application is denied based on on A2p issue with company A.

I had company B already filed for my labor in 2008 and approved in Jan 2009. They also filed concurrent 140 and 485 in March 2009 which is still pending. Company B wanted to hire me and now its time that I move to company B. I do have latest paystubs from Company A, currently valid i797 and experience letter.

can I migrate to company B by transfering my h1b based on approved labor with company b and pending GC application. What documents are required to transfer.

Her H4 is not dependent upon the employer but on her spouse maintaining a valid H1 with an employer. There is no need for your wife's friend to worry or do anything.
However, if she wants to get a visa stamp, she would have to go with her husband's current H1 I797 at that time.

Hi
I transferred my H1 to new employer and need to go for visa stamping.
I have a couple of qustions.

1.I belong to south india and my regional consulate is chennai.Can I go for calcutta consulat as I heard chennai consulate has delays in vsa processing.In such case,can I have to show any emergency proof?

2.My salary is 30k more than whatever is mentioned in petition.will it be a problem?

3.I recently heard that consulate officer is asking for contact agreement between employer and client.But in my case I have some addition layer B in between my employer A and client.So how can I provide letter.Do I need to show 2 letters.From my employer A to layer B and layer B to client?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

Your H1 is NOT subject to cap as you had H1 in last 6 years.

I have an approved I140 and eligible to apply for I485. My wife is in the same situation.

Should we file separate? Or should I file only one application heither through my employer or hers?

I believe finger print needs to be obtained somehow to varify the person. Hope it is not damaged too much. Why dont you try to obtain a doctor's letter stating that she had some blisters and is recovering? Usually for ladies it shouldn't be much of an issue but just as a precaution. The POE officers are usually good towards Indian ladies, particularly when they travel alone. So dont worry too much.

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.

Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

NVC got my documents for 1 month

I am considering to email the NVC to check on the status of my case.

Should I email the NVC to check now (after waiting for 1 month) or wait another month (hence I would have waited 2 months) to check with the NVC on my status?
